1.1. The Refract Referral Program allows approved affiliates to earn a commission on Qualified Referrals, subject to these Terms and any additional policies or requirements established by Refract from time to time.
1.2. Participation in the Referral Program constitutes acceptance of these Terms and all related Refract policies.
1.3. Refract reserves the right to modify, suspend, terminate, or discontinue the Referral Program at any time and for any reason.
2.1. A "Qualified Referral" is a net-new customer who:
(a) has never previously held a Refract membership or subscription;
(b) has never previously purchased, activated, renewed, or otherwise accessed Refract services;
(c) completes a purchase through a valid referral link assigned to an approved affiliate; and
(d) remains in compliance with all Refract Terms of Service.
2.2. Referral commissions are earned solely on Qualified Referrals approved by Refract.
2.3. Refract shall have sole discretion in determining whether a referral qualifies for commission.
The following activities are strictly prohibited:
You may not refer yourself under any circumstances.
This includes, but is not limited to:
(a) creating additional accounts;
(b) using alternate email addresses;
(c) using alternate payment methods;
(d) purchasing through your own referral link; or
(e) otherwise attempting to generate referral commissions from your own purchases.
You may not receive referral credit for:
(a) current Refract members;
(b) former Refract members;
(c) customers with previous subscriptions;
(d) customers previously identified in Refract systems; or
(e) customers already known to Refract through prior purchases, memberships, support interactions, or account activity.
Refract maintains strict fraud-prevention and referral-tracking systems.
Only one Qualified Referral may be credited per household.
For purposes of fraud prevention, Refract may consider factors including, but not limited to:
(a) IP address;
(b) physical address;
(c) payment method;
(d) device information;
(e) browser information; and
(f) account ownership information.
Multiple purchases associated with the same household may be denied referral credit in Refract's sole discretion.
You may not:
(a) use referral links to obtain discounts for yourself;
(b) coordinate purchases with friends, family members, roommates, or associates to generate commissions;
(c) share commissions, rebates, or kickbacks with referred customers;
(d) use another person's referral link to obtain discounted access to Refract; or
(e) engage in any activity intended to circumvent the purpose of the Referral Program.
The Referral Program exists solely to reward the acquisition of legitimate net-new customers.
4.1. Referral attribution is determined solely by Refract's tracking systems.
4.2. Refract does not guarantee that every referral attempt will be successfully tracked or credited.
4.3. Refract's determination regarding referral attribution shall be final.
5.1. Refract reserves the right to reject, withhold, reverse, cancel, or claw back any referral commission at any time.
5.2. Referral commissions may be denied or reversed if Refract determines, in its sole discretion, that:
(a) the referral violated these Terms;
(b) the referral was fraudulent;
(c) the referral was not a Qualified Referral;
(d) the referral involved self-referral activity;
(e) the referral involved an existing or former customer; or
(f) the referral otherwise conflicts with the intended purpose of the Referral Program.
6.1. Refract may suspend or terminate any affiliate's participation in the Referral Program at any time and without notice.
6.2. Any violation of these Terms may result in:
(a) removal from the Referral Program;
(b) forfeiture of unpaid commissions;
(c) reversal of previously approved commissions; and
(d) termination of access to Refract services.
7.1. Refract reserves the absolute right to review, approve, reject, investigate, reverse, or terminate any referral, affiliate account, commission, or payout.
7.2. All decisions made by Refract regarding referral eligibility, attribution, fraud prevention, commission qualification, and program participation are final and binding.
